SpellMaker.ai is an AI-powered entertainment tool that generates fictional magic spells based on user descriptions. The Service is provided for entertainment purposes only. Generated content is fictional and has no real-world magical properties.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements.

4. User Accounts

You may create an account by providing your email address. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to update it as necessary.

5. Free and Paid Usage

Free tier: 1 spell per day without an account. Registered users receive 2 additional free spells upon registration.
Paid packs: Additional spells may be purchased in packs. All purchases are final and non-refundable, except as required by applicable law.
Pricing: We reserve the right to change pricing at any time. Changes do not affect previously completed purchases.

6. Acceptable Use

You agree not to use the Service to:

Generate content that is hateful, discriminatory, violent, sexually explicit, or otherwise harmful
Attempt to bypass content moderation or rate limits
Use automated tools to access the Service at scale
Impersonate others or misrepresent your identity
Interfere with the Service's operation or security

We reserve the right to suspend or terminate accounts that violate these terms.

7. Generated Content

Spells are generated by AI and may not be unique. Similar prompts may produce similar results for different users.
You may use generated spells freely — sharing on social media, personal entertainment, content creation (YouTube, blogs, streams), and similar purposes.
We do not claim ownership of the specific spell combinations generated for you.
We reserve the right to use anonymized, aggregated data about generated content to improve the Service.

8. Intellectual Property

The SpellMaker.ai name, logo, design, and underlying technology are our property. The Service is inspired by magical fiction but is not affiliated with, endorsed by, or connected to any specific franchise, publisher, or trademark holder.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that generated content will be appropriate, accurate, or suitable for any purpose.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify registered users of material changes via email.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Service operator resides, without regard to conflict of law principles.
